Former College Dorm Advisor's Options Limited to Workers' Comp

RALEIGH, N.C. - A former college residence hall advisor claiming a permanent respiratory illness from mold in a college dorm is precluded by the state's Workers' Compensation Act from bringing a tort action for damages, North Carolina's Court of Appeals ruled on May 20. Christopher v. North Carolina State University, No. COA07-1516 (N.C. Ct. App.).
The court affirmed findings of the North Carolina Industrial Commission. which ruled that J. Kamau Christopher could not pursue his $150,000 action under the Tort Claims Act because the Workers' Compensation Act provides the exclusive remedy for his injury.
