SEATTLE - A Washington appellate court has ordered a new trial on claims by a teacher that she suffers from mold-related illness that manifested five years after exposure. Shillinger v. Highline School District No. 401, No. 60452-0-I (Wash. Ct. App., Div. 1).
The Court of Appeals, Division One, said in its May 27 opinion that despite finding insufficient evidence to support Annette M. Shillinger's claim for occupational benefits, it could not order judgment notwithstanding the verdict because Shillinger did not move for judgment as a matter of law before the case was sent to the jury.
