Court Dismisses Homeowners' Claims for Anguish, Loss of Work, Vacation

NEW YORK - A New York court has ruled that a homeowner who sued a builder over alleged roof leaks, mold and other construction-related problems cannot sue for lost rents, mental anguish or other consequential or indirect damages. Kanas v. Strategic Columbia Enterprises LLC, et al., No. 602838/07 (N.Y. Sup. Ct., N.Y. Cty.).

New York Supreme Court Justice Judith J. Gische also ruled on May 14 that plaintiff Jennifer Kanas cannot pierce developer the builder's corporate veil to bring claims against that firm's principal owner.
