OLYMPIA, Wash. - A Washington State appellate panel has affirmed a verdict in favor of a lumber mill worker who sought disability benefits for health problems she blamed on long-term exposure to fungicides used to prevent mold in new lumber. Lewis v. Simpson Timber Co., No. 36268-6-II (Wash. Ct. App.).
The Washington Court of Appeals, Division II, said in its April 30 opinion that in viewing the evidence in favor of the claimant, it could not say the evidence was not substantial or there was no reasonable basis for the verdict in her favor.
