5th Circuit Cites Recent Opinion in Affirming Denial of Mold Coverage

NEW ORLEANS - The 5th Circuit Court of Appeals cited one of its own recent holdings in affirming a lower court that denied coverage for Texas homeowners who claimed that leaky plumbing led to mold damage. Mungia, et al. v. State Farm Lloyds, No. 07-40283 (5th Cir.).
The court said in a one-paragraph unpublished opinion on April 28 that it addressed the identical issue raised by appellants Guillermo and Erminia Mungia in Carrizales v. State Farm Lloyds (518 F.3d 343 [5th Cir. 2008]), "and that mold damage to the dwelling is not covered under the policy language at issue here" …
