Wis. Supreme Court Affirms Multiple Damages for Homeowners

MADISON, Wis. - The Wisconsin Supreme Court has affirmed an intermediate court's holding that the state's Home Improvement Practices Act allows for the doubling of a jury award to homeowners even though only a portion of the award was based on statutory violations. Stuart v. Weisflog's Showroom Gallery Inc., et al., No. 2008 WI 22 (2005AP886) (Wis. Sup. Ct.).
The high court also found on March 28 that the economic loss doctrine was inapplicable to the homeowners' claims and, thus, damages were not limited by the remodeling contract between the homeowners and Weisflog's Showroom Gallery Inc.
