MONTPELIER, Vt. - The Supreme Court of Vermont has ruled that a retaliation claim filed by a teacher who suffered migraines and allergies from mold and other environmental conditions at the school where she worked can proceed to trial. Ann Mellin v. Flood Brook Union School District, Department of Education, et al., No. 2000-143 (Vt. Sup. Ct.).
While affirming other respects of the trial court's order, the Supreme Court reversed an order on the plaintiff's retaliation claims and on the Flood Brook Union School District School Board of Directors' claims for qualified immunity in their personal capacities. These claims were …
