Mo. High Court Orders Reconsideration of Damages in Municipal Suit

JEFFERSON CITY, Mo. - The Missouri Supreme Court has ordered a trial court to reconsider a city's demand to reduce damages for inverse condemnation in light of the evidence presented by a homeowner who was awarded $399,500 in a trial over sewage backups and related mold contamination. Collier v. City of Oak Grove, Mo., No. SC88580 (Mo. Sup. Ct.).

The high court said on March 18 in reversing a decision by the Circuit Court of Jackson County that a $100,000 award for personal property was excessive given the plaintiff's failure to detail her losses.
