Del. Court Reinstates Coverage Suit Over Damage to Personal Property

WILMINGTON - The Delaware Supreme Court has vacated summary judgment awarded to a home insurer, finding that a trial court erred in ruling that mold damage to personal property was excluded from coverage. Sullivan v. The Standard Fire Insurance Co., No. 515,2007 (Del. Sup. Ct.).

The high court said there are triable issues of fact remaining, including whether rain entered the home as a result of wind damage to the roof and whether the rain caused the mold damage to the personal items.
