TRENTON, N.J. - A New Jersey appellate court has affirmed trial court orders granting summary judgment to a home insurer, a public adjuster and two contractors blamed by homeowners for mold growth after a 2003 fire. Lucky v. Liberty Mutual Fire Insurance Co., et al., No. A-0383-06T1 (N.Y. Super. Ct., App. Div.).
The New Jersey Superior Court Appellate Division reversed judgment awarded to another remediation firm, however, ruling in its Feb. 13 per curiam opinion that the homeowners offered sufficient evidence to support their claim that the contractor's work contributed to the mold contamination.
