5th Circuit Affirms $4,315 Judgment in Texas Insurance Case

NEW ORLEANS - A 5th Circuit panel has affirmed a jury's decision to award minimal damages to a homeowner who sought coverage from Allstate Texas Lloyds Co. for mold and water damage from a series of leaks in a 50-year-old home. Garza v. Allstate Texas Lloyds Co., No. 06-40359 (5th Cir.).

The panel said in a per curiam opinion on Feb. 6 that the trial court did not err in excluding testimony on foundation damage or in reducing a $3,000 jury award for damage to a shower by the policy's "per loss" deductible of $2,185.
