California Tenants Sue Landlords/Owners for 'Toxic Mold' in Apartments

SANTA ANA, Calif. - A complaint filed Dec. 14 against the landlords and owners of Park West Apartments in Irvine, Calif., alleges that two tenants suffered physical injury and personal property damage due to the defendants' failure to repair the known existence of mold in their apartment unit. Ruthmarie Creighton and Tony Hahn v. Park West Apartments, et al., No. 01CC15945 (Calif. Super. Ct., Orange Cty.).

According to the complaint filed in Orange County Superior Court, the defendants were aware of the existence of "toxic mold" in the unit at the time that it was leased to the plaintiffs.
