PHILADELPHIA - A Pennsylvania appellate panel has ruled that neither faulty workmanship by subcontractors in installing siding and windows nor ancillary water and mold damage were covered under various insurance policies issued to a developer. Millers Capital Insurance Co. v. Gambone Brothers Development Co., Inc., et al., No. 1420 EDA 2007 (Pa. Super. Ct.).
The Pennsylvania Superior Court on Dec. 28 affirmed summary judgment for Millers Capital Insurance Co. on Gambone Brothers Development Co.'s demand under personal injury, umbrella and commercial general liability policies for a defense and indemnification of claims by purchasers of Gambone properties.
