WEST PALM BEACH, Fla. - A Florida appellate court has lifted an order barring a remediation contractor from offering opinions on whether his clients' insurance would cover mold, saying there was no compelling need for the order. Kodsy v. Department of Financial Services of the State of Florida, No. 4D07-54 (Fla. Ct. App., 4th Dist.).
The 4th District Court of Appeal said in its Jan. 2 opinion that Florida's Department of Financial Services issued the cease-and-desist order without giving Sherif Kodsy a hearing and without any evidence that the order was necessary to prevent an emergency.
