DETROIT - A federal judge has dismissed a cemetery worker's whistleblower claims against her employer but said her mold personal injury claims are not, as alleged, precluded by the state's workers' compensation scheme and can continue. Thomas v. Miller, et al., No. 07-11760 (E.D. Mich.).

Judge Julian A. Cook Jr. of the U.S. District Court for the Eastern District of Michigan ruled on Jan. 9 that Silvia J. Thomas failed to pursue administrative relief before asserting wrongful termination and whistleblower claims related to her work for Elmwood Cemetery.
