Illinois School District Files Petition to Appeal Denial of Motion to Dismiss Class Action

GENEVA, Ill. - The defendant in a mold-related class action lawsuit filed by St. Charles East High School students, former students, and staff last week filed a petition for leave to appeal a recent court ruling denying its motion for dismissal. Steinberg, et al. v. Community Unit School District 303, No. 01-CH-K-334 & 01-LK-150 (Ill. Cir. Ct., Kane Cty.).

Defense attorney Robert W. Smyth, Jr. of Donohue, Brown, Mathewson & Smyth in Chicago confirmed that he filed the petition for leave to appeal the Kane County Circuit Court's Nov. 7 denial of the defendant's motion to dismiss the case.
