Md. Court Affirms JNOV for Landlord on Deceptive Practices Claim

ANNAPOLIS, Md. - Maryland's high court has affirmed judgment for a landlord after concluding that a "continuing harm" rule did not toll the statute of limitations on a tenant's unfair and deceptive practices claim. MacBride v. Pishvaian, No. 42, Sept. Term 2007 (Md. Ct. App.).

The Court of Appeals held Dec. 13 that neither "continuing events" nor 'continuing harm' theories applied and that, in any case, the tenant should have been aware of her claim more than six years before filing the complaint.
