N.Y. Plaintiff Appeals Constructive Notice Issue to State's High Court




NEW YORK - A woman who claims that she suffers from mold-related allergies, breathing problems and cognitive disorders because of her landlord's failure to make timely repairs of water leaks and mold has asked the New York Court of Appeals to overturn dismissal of her lawsuit. Litwack v. Plaza Realty Investors Inc., No. 104745/02 (N.Y. Sup. Ct., App. Div., 1st Dept.).

The New York Supreme Court Appellate Division, 1st Department, granted Wendy Litwack leave to appeal on Nov. 1 and the Court of Appeals noted Litwack's petition in its list of newly filed appeals for Nov. 9-15.
