Jury Awards Rent Rebate but No Personal Injury Damages

SANTA ANA, Calif. - A California Superior Court jury ended a three-week trial on Nov. 1 by awarding a mold plaintiff two months in lost rent but rejected her $1.3 million demand for personal injury damages. Brogren v. Plueger, No. 05CC09153 (Calif. Super., Orange Cty.).
The landlord defendants cited the $1,800 rent award in moving for costs after trial. Defendants say they are entitled to recover costs and fees because the Orange County jury awarded plaintiff Cari Brogren less than defendants $5,001 statutory pre-trial offer to compromise.
