Ore. Court Affirms $31,620 Judgment Against Home's Architects

PORTLAND, Ore. - An Oregon appeals court has affirmed a $31,620 judgment against a home designer and construction overseer despite the homeowner's contention that that the trial court erred in excluding a medical expert and in denying the homeowners' leave to add a $2.5 million negligence claim prior to trial. O'Hara v. David Blain Construction, et al., No. A130545 (Ore. Ct. App.).
The Court of Appeals also rejected the homeowners' contention that jurors meant for their damages award to apply to the husband and wife individually, saying that while the verdict sheet was ambiguous, plaintiffs should have raised that issue …
