ALEXANDRIA, Va. - A federal judge awarded summary judgment to an insurer after finding that mold on roof trusses installed in a townhouse project was not an "occurrence" triggering coverage under the building contractor's umbrella policy. Stanley Martin Companies Inc. v. Ohio Casualty Group, No. 1:06cv1035 (JCC) (E.D. Va.).
Judge James C. Cacheris of the U.S. District Court for the Eastern District of Virginia ruled for Ohio Casualty Group on Oct. 2, applying Virginia law in concluding that defective workmanship clauses precluded coverage.
