SAN DIEGO - A California appellate court has vacated a judgment in favor of the owners of a leaky motor home, finding that the owner's unsupported subjective opinion was insufficient to prove damages. Deitrick, et al. v. National RV Inc., No. D048378 (Calif. Ct. App., 4th App. Dist.).
The 4th District Court of Appeal said in its Oct. 29 unpublished opinion that Marlene Deitrick's testimony that the motor home had lost half of its $132,815 value was not evidence of fair market value as required by California's Uniform Commercial Code (§ 2714, Subd. [2]).
