Workers Fail to Identify Expert by Discovery Deadline

ATLANTA - A federal judge has denied as moot a defense motion to exclude expert testimony on behalf of plaintiffs alleging injuries from workplace mold exposure, saying it was unnecessary given that plaintiffs haven't identified an expert. Brown v. Equity Office Management LLC, et al., No. 1:06-cv-2920d-WSD (N.D. Ga.).
The denial came in a Sept. 25 ruling by Judge William S. Duffey Jr. of the U.S. District Court for the Northern District of Georgia, who also declined to extend a Sept. 7 discovery deadline.
