Federal Court Denies Summary Judgment to Fla. Roofer's Insurer

MIAMI - A federal judge has denied an insurance carrier's motion for summary judgment on a roofer's claim for coverage of an underlying lawsuit, finding that issues of fact remain as to when the insured was aware of the potential claim. Transportation Insurance Co. v. The Regency Roofing Companies Inc., No. 05-80830 (S.D. Fla.).

Judge Donald M. Middlebrooks of the U.S. District Court for the Southern District of Florida also denied summary judgment on Regency Roofing Companies' bad faith claim against Transportation Insurance Co., saying in his Oct. 4 order that it was premature.
