COLUMBUS, Ohio - The Ohio Supreme Court has ordered summary judgment awarded in a mold case after finding that plaintiffs failed to provide the necessary expert medical testimony on specific causation. Terry, et al. v. Caputo, et al., No. OT-05-009 [Ohio St.3d, 2007-Ohio-5023] (Ohio Sup. Ct.).
One dissenting justice said in response to the court majority's Oct. 5 opinion that the majority had turned "that low hurdle' of summary judgment 'into a brick wall."
