SAN ANTONIO, Texas -A Texas appellate court has affirmed summary judgment for a real estate agent and brokers after finding no evidence that plaintiff homeowners relied on the agent's alleged misrepresentations before buying a home. Lim v. Lomeli, et al., No. 04-06-00389-CV (Texas Ct. App., 4th Dist.).

The 4th District Court of Appeals also held in its Aug. 29 opinion that Satex Properties, the agent's employer, and Best Homes, the listing broker, could not be vicariously liable absent some evidence of liability on the part of their buyer's agent, Eliseo Lomeli.
