ST. PAUL, Minn. - Minnesota's Court of Appeals has affirmed summary judgment for home sellers, their builder and real estate agents accused of misleading buyers who experienced mold and other problems after moving into a four-year old house. Nance v. Evje, et al., No. C4-06-106 (Minn. Ct. App.).
The appellate court agreed with the trial court that Linda and Eric Nance failed to show that the sellers misrepresented any known facts in the sellers' disclosure forms or that defendants should have warned the Nances of possible problems with a house constructed on the slope of a hill.
