WILMINGTON, Del. - A Delaware judge has granted summary judgment to a home insurer after concluding that mold contamination of personal property was not a "direct physical loss" within the meaning of the policy. Sullivan v. The Standard Fire Insurance Co., No. 04C-11-214 MJB (Del. Super. Ct., New Castle Cty.).
New Castle County Superior Court Judge M. Jane Brady said in an Aug. 29 opinion that cases relied on by plaintiffs were not analogous and that, in any event, the policy language requiring a showing of direct loss was unambiguous.
