NEW YORK - A New York trial court has denied summary judgment to a Manhattan condominium board and individual board members sued by a former resident who blames the board for mold and bacteria in her home. Zachry v. Village Point Condominium, No. 102272/2005 (N.Y. Sup., N.Y. Cty.).
New York County Supreme Court Justice Louis B. York ruled on July 24 that Nancy G. Zachry can pursue her $954,695.92 claim against the board and individual board members despite a lack of causation evidence linking her claimed illness to mold exposure.
