BROOKLYN, N.Y. - A motion by the New York Department of Housing Preservation and Development (DHPD) to vacate a court order to correct hazardous mold conditions in a New York apartment has been denied by a New York court. Aybar v. Tsionkas, No. n/a (N.Y. Sup. Ct., Kings Cty.).
Under what the court called 'extraordinary circumstances,' the DHPD was ordered Oct. 24 to correct 21 hazardous violations in the petitioner's mold-contaminated apartment based on jurisdiction provided by the New York City Charter and Administrative Code 110(c).
