NEW ORLEANS - The 5th Circuit Court of Appeals has affirmed a verdict in which a jury awarded no damages for homeowners' claimed mold damages, despite finding that their insurer breached the insurance contract. Foster v. Allstate Insurance Co., No. 06-50398 (5th Cir.).
In an unpublished opinion issued on June 25, the three-judge panel concluded after reviewing the record that the verdict "was neither irreconcilable nor against the great weight of the evidence."
Bob and Carol Foster sued Allstate for $447,000 in damages for personal property lost as the result of mold damage discovered in 2001.
