photo-2 With the recent proliferation of concerns and claims involving the potential adverse health effects of exposure to mold, an interesting question arises as to whether the most commonly alleged injury, an allergic reaction, constitutes a bodily injury for which compensation can be awarded in a lawsuit. Although scientific and medical literature is still in its infancy on the issue of the adverse health effects causally related to exposure to molds, there is a consensus that individuals with predispositions to allergies or respiratory ailments (asthma) may suffer from allergic reactions when exposed to high concentrations of molds.
