N.J. Court Affirms Attorney and Expert Fee Awards Against Landlords

TRENTON, N.J. - New Jersey's Superior Court Appellate Division on June 25 affirmed an award of attorney fees and expert witness fees to a couple who successfully defended an eviction action by their landlords after the couple sought a rent reduction based on mold contamination in two rooms of their residence. Anastasio v. Kaltner, No. A-0647-06T1 (N.J. Super. Ct., App. Div.).

The appellate court affirmed the lower court's finding of "bad faith maliciousness" on the part of a landlord-attorney, and the award of $5,775 in attorney fees and $800 for an expert witness for the tenants.
