MARSHALL, Texas - A federal judge has upheld a health insurer's decision to reject $77,059.75 in claims for diagnosis and treatment of a family's mold-related illnesses, saying the claim denial was not arbitrary or capricious. Campbell v. ExxonMobil Medical Plan, No. 2:05-cv-165 (E.D. Texas).
In a report and recommendation adopted by the court, Magistrate Judge John D. Love of the U.S. District Court for the Eastern District of Texas also found May 31 that Dr. Andrew W.
