Appeals Court Says College Did Not Discriminate Against Post-Doc with Mold Allergy

TRENTON, N.J. - A New Jersey Appeals Court has upheld a lower court's award of summary judgment to a university accused of discriminating against a post-doctoral candidate because he suffered from a mold allergy. Connell v. Princeton University, No. A-6388-99T3 (N.J. Super. Ct., App. Div.).

In an Oct. 3 decision, the New Jersey Superior Court Appellate Division ruled that because the school did all it could to accommodate the student's condition, it could not be inferred that the student's termination from the graduate program was arbitrary and capricious and a consequence of his handicap.
