NEW YORK - A New York trial court has granted a defense motion for summary judgment and dismissed all claims brought by tenants against their building managers, ruling that tenants were not third-party beneficiaries of contracts between the managers and the building's owners. Fraser v. Picaso Inc., et al., No. 103256/05 (N.Y. Sup., New York Cty.).
New York County Supreme Court Justice Shirley W. Kornreich also ruled on July 5 that the dismissal of personal injury claims brought by Colin Fraser and his family against the property owners has collateral estoppel effect on the personal injury claims in this case …
