WILMINGTON, Del. - A Delaware trial judge has affirmed an administrative board's rejection of permanent disability status for a former DuPont Co. employee with a sensitivity to mold that began during his DuPont employment. Pekala v. E.I. DuPont De Nemours & Co., No. 06A-04-014WCC (Del. Super. Ct., New Castle Cty.).
Delaware Superior Court Judge William C. Carpenter Jr. said in a May 31 opinion that there was sufficient evidence to support the Industrial Accident Board's rejection of the workers' compensation claim brought against DuPont by Robert E. Pekala.
