TEXARKANA, Texas - A homeowner's failure to comply with a requirement for timely written notice relieved her home insurer of liability for coverage of hail damage and mold, a Texas appellate court held on June 1. Caddell v. Travelers Lloyds of Texas, No. 06-06-00063-CV (Texas Ct. App., 6th Dist.).
The 6th District Court of Appeals at Texarkana affirmed summary judgment for Travelers Lloyds of Texas Insurance Co., holding that notice was a condition precedent and Travelers need not show prejudice to deny coverage.
