NEW YORK - A New York trial judge has ordered Fireman's Insurance Company of Washington, D.C., to contribute a pro rata share to the defense of a building owner in a personal injury case. Carroll v. Nostra Realty Corp., No. 109293-2002 (N.Y. Sup., N.Y. Cty.).
Justice Carol Robinson Edmead of the New York County Supreme Court on May 22 granted a motion for summary judgment by Nostra Realty Corp. and two other insurers, ruling that evidence in the record supports the view that Nostra may be liable for injuries that occurred to tenants during FICO's policy periods.
