Court Refuses to Set Aside $1.5 Million Default Judgment

COLUMBIA, S.C. - The South Carolina Court of Appeals has affirmed a trial court's refusal to vacate a $1.5 million default judgment against a roofing contractor, finding no abuse of discretion in the lower court's rulings. Bage LLC v. Southeastern Roofing Co. of Spartanburg Inc., No. 4240 (S.C. Ct. App.).
The Court of Appeals agreed in an April 23 opinion that Southeastern Roofing Co. of Spartanburg was properly served and couldn't show good cause for its failure to respond to the lawsuit by Bage LLC, a commercial building owner.
