Calif. Appellate Court Affirms Dismissal for Delays

LOS ANGELES - A California appellate panel has affirmed dismissal of mold claims against a county water district for personal injury plaintiffs' delays in making their medical expert available for deposition, or "to present any case at all." Aleman v. La Puente Valley Water District, No. B189019 (Calif. Ct. App., 2nd Dist.).

The Court of Appeal, 2nd District, said in its unpublished opinion on May 15 that the trial court rejected plaintiffs' efforts to continue a trial date because of a request by their chosen medical expert that his deposition be postponed because of reasons other than a scheduling conflict.
