AKRON, Ohio - Evidence of a couple's willingness to allow their real estate agent to arrange for a home inspection binds them to the arbitration clause in the inspection agreement signed by the agent, an Ohio appellate court ruled on April 16. Church v. Fleishour Homes, Inc., et al., No. 2006-CA-00233 (Ohio Ct. App., 5th Dist.).
Ohio's Fifth District Court of Appeal also ruled however, that the agreement doesn't bind the couple's minor child, who is not seeking to enforce any contract and is not, therefore, bound by the same agreement.
