RIVERHEAD, N.Y. - A New York Supreme Court justice has denied a contractor's motion for summary judgment on damage claims brought by its client's home insurer, finding that liability issues are still unresolved. State Farm Fire & Casualty Co. v. Whistle Clean by Warren Services Inc., No. 15266/05 (N.Y. Sup., Nassau Cty.).
Nassau County Supreme Court Justice Anthony L. Parga denied the motion by Whistle Clean by Warren Services Inc. on April 3, saying there are still 'questions of fact as to State Farm's responsibilities' for mold contamination that arose after remediation of flood damage in July 2004.
