NEW ORLEANS - The 5th Circuit Court of Appeals affirmed summary judgment for Allstate Texas Lloyds Insurance Co. on March 29 after finding one claim by the insured homeowners' time-barred and no evidence to counter Allstate's expert testimony on a second claim. Watson v. Allstate Texas Lloyd's, No. 05-20592 (5th Cir.).
The 5th Circuit panel found for Allstate in its per curiam opinion even though the judges rejected Allstate's contention that all of the damage claimed by Archie and Cynthia Watson was caused by mold, which would be excluded, rather than by water.
