Court Rejects Former Tenants' Attempt to Sue Landlords' Attorneys

LOS ANGELES - A California appellate court affirmed a lower court's decision to deny plaintiffs leave to assert conspiracy claims against their former landlords' attorneys, saying the activities complained of fall within the absolute privilege afforded judicial, or quasi-judicial, proceedings. Beaty v. Raasch, No. B188980 (Calif. Ct. App., 2nd Dist.).
The Court of Appeals, Second District, agreed with the Los Angeles County Superior Court that Pamela Beaty and her co-plaintiffs failed to demonstrate that they have the 'probability of success' required of parties seeking leave to sue an attorney (Calif. Civ. Code § 1714.10).
