LANCASTER, Pa. - In a series of responses filed Sept. 7, defendants in a Pennsylvania class action have denied the necessity for an expedited trial involving claims that a defective exterior cladding product has precipitated the development of mold. Susan K. Lape, et al. v. Murry Development, et al., No. CI-00-09239 (Pa. Comm. Pls., Lancaster Cty.).
The plaintiffs have requested the expedited trial primarily out of fear that Dryvit Systems, Inc., the main defendant from whom recovery is being sought, will exhaust its insurance coverage before compensation can be made.
