Ky. Supreme Court Affirms Occupational Disease Ruling against Nurse

FRANKFORT, Ky. - Kentucky's high court on Feb. 22 affirmed an administrative judge's rejection of a workers' compensation claim by a nurse who was diagnosed by an environmental health clinic as suffering from a mold-related brain injury. Walker v. Cabinet for Health Services, No. 2006-SC-0360-WC (Ky. Sup. Ct.).

The Supreme Court noted in an unpublished opinion on Feb. 22 that pro se appellant Ruth Walker had collected a prior settlement for long-term latex sensitivity, and concluded that 'favorable evidence was not so overwhelming.'

Walker sought benefits from Cabinet for Health Services, maintaining that exposure to mold, ink, solvents and chemicals …
