RICHMOND, Va. - A Virginia Circuit Court judge who excluded testimony by plaintiff's medical expert before trial vacated a $760,000 jury award on Feb. 2, saying the jury had insufficient evidence on which to base the verdict for three individuals who sued their landlord over alleged mold injuries. Odaris v. Morton G. Thalhimer, Inc., No. LS-2258-4 (Va. Cir. Ct., City of Richmond).
Richmond Circuit Court Judge Melvin R. Hughes Jr. left intact a separate $20,000 verdict for property loss and is considering plaintiffs' motion for attorney's fees as the prevailing party on that basis under Virginia's landlord-tenant statute.
