Court Affirms Verdict and Attorney Fees in Neighbor Dispute

CLEVELAND - An Ohio appellate court ruled on March 1 that a trial judge had sufficient evidence to award compensatory and punitive damages, as well as attorney fees, to a woman who complained that a neighbor's construction project led to basement mold and flooding on her property. Verchio v. Gregory, No. CV-504721 (Ohio Ct. App., 8th Dist.).

The 8th Appellate District affirmed a bench verdict for Valerie Verchio, including a finding that her neighbors, Eddie and Christine Gregory, acted with malice, and the trial court's award of $8,601.66 in compensatory damages, $1,000 in punitive damages and $17,365.56 in attorney fees.
