RIVERHEAD, N.Y. - The owner of a roofing company is not personally liable for mold claims brought by a client, a New York trial court held Feb. 5 in dismissing claims against that individual. Orens v. Unkrich Contracting, Inc., et al., No. 7879/04 (N.Y. Sup., Nassau Cty.).
Nassau County Supreme Court Justice Antonio I. Brandveen ruled that because defendant John Unkrich signed all documents, invoices and contracts as an officer of Unkrich Contracting Inc., he could not be liable for what amount to breach-of-contract claims brought by condominium owners Perry and Elaine Orens.
